Terms and Conditions for Orchard Forex Trading Academy Membership

By joining the Forex Academy and making a deposit to the designated broker, you agree to the following terms and conditions:

1. Membership Eligibility

1.1. To join the Forex Academy, you must be at least 18 years old and legally eligible to trade in your jurisdiction.
1.2. You must make a minimum deposit of USD2000 to the designated broker to activate your membership.
1.3. By joining, you confirm that you have read, understood, and agree to these terms and conditions.

2. Deposit Requirements

2.1. The deposit made to the broker will be transferred as ‘Trader Equity’ and noted as such into your funded Orchard Academy Trading account.
2.2. The deposit must be made through approved payment methods as specified by the broker.
2.3. The deposit is subject to the broker’s terms and conditions, including any fees or charges applicable to deposits or withdrawals.
2.4 You may top up the equity in your Academy Account should you wish and and profit sweep share for the Academy will be made on a new net profit basis only, taking into account any further deposits or account top ups that a Trader may make.

3. Forex Academy Tools

3.1. Upon successful deposit, you will gain access to the following tools:

Expert Advisors: Access to exclusive expert advisors that will be available to backtest and trade onto Academy accounts.
Portfolio Stacker: Use of and access to a backtest portfolio stacker which can assist with simulating how using multiple symbols and multiple EA’s may look like from a portfolio level viewpoint.
Telegram Channel Access: See guidance on how Orchard Academy are trading on their own accounts.
3.2. These benefits are provided for educational purposes only and do not guarantee trading success or profits.

4. Trading Conditions

4.1. The deposit made to the broker will be used as trading capital, and you are solely responsible for all trading activities in your Orchard Academy account.
4.2. The Academy does not manage or control your trading account. All trading decisions and risks are your responsibility.
4.3. You acknowledge that Forex trading involves significant risk, including the potential loss of your entire deposit.

5. Broker Relationship

5.1. The broker is an independent entity, and the Academy is not responsible for the broker’s services, platform, or any issues arising from your use of their services.
5.2. You agree to comply with the broker’s terms and conditions, including any fees, leverage limits, and withdrawal policies.
5.3. The Academy does not guarantee the performance, reliability, or security of the broker’s platform.

6. Membership Duration and Renewal

6.1. Your membership in the Forex Academy is valid while you maintain a trading account with our Broker Partner.
6.2. To continue accessing Academy benefits after the initial period, you may be required to renew your membership by making an additional deposit or payment.

7. Termination of Membership

7.1. The Academy reserves the right to terminate your membership at any time if you violate these terms and conditions or engage in fraudulent or unethical behavior.
7.2. You may cancel your membership at any time, and your deposit equity in the Academy Account (less any profit sweep share) will be returned to your wallet account at the Broker.

8. Limitation of Liability

8.1. The Academy is not liable for any losses, damages, or expenses incurred as a result of your trading activities or use of the broker’s platform.
8.2. The Academy does not guarantee any specific trading results, profits, or performance.
8.3. You agree to indemnify and hold the Academy harmless from any claims, losses, or liabilities arising from your use of the Academy’s services or the broker’s platform.

9. Amendments to Terms

9.1. The Academy reserves the right to modify these terms and conditions at any time. Any changes will be communicated to you via email or through the Academy’s website.
9.2. Continued use of the Academy’s services after changes are made constitutes your acceptance of the updated terms.

10. Profit Sweeps and Profit Share

10.1. Academy accounts which have a net profit (basis equity) of 20% or higher at end of month (NY 1700 last calendar day) will see a profit sweep occur the following business day of the entire net profit amount and Trader share is deposited into their funding account.
